Terms of Use

The legal entity operating the Platform is still being incorporated. Company name, address, MERSİS and VERBİS numbers appear below as placeholders ({{SIRKET_UNVANI}}, {{SIRKET_ADRESI}}, {{MERSIS_NO}}, {{VERBIS_NO}}) and will be filled in once incorporation completes.

We chose to leave these fields visibly empty rather than invent a company name: a missing field is visible, a fabricated one is not.

1. Parties and Scope

These Terms of Use govern your access to and use of the platform at eflatun.ai (the "Platform"), operated by {{SIRKET_UNVANI}} ("Eflatun", "we"). By using the Platform you accept these terms.

If you do not accept them, please do not use the Platform. You may permanently delete your account at any time from your profile settings.

2. What the Service Is

The Platform provides tools that generate text, images, video, audio and 3D content through artificial intelligence models. Services are provided "as is"; we do not guarantee a particular result, accuracy or uninterrupted availability.

Models, prices and the list of services may change without prior notice. Your unused Gems balance is not affected by such changes.

3. Your Account

Some services require an account. You are responsible for keeping your credentials confidential and for activity carried out through your account. If you notice unauthorised use, notify us immediately at hukuk@eflatun.ai.

If you are under 18, you may use the Platform only with the consent of a parent or legal guardian.

4. Gems and Payment

Generations on the Platform are charged in a prepaid unit called "Gems". How many Gems each service consumes is shown on the service page and again before you generate.

  • When you register, a one-time welcome Gems grant is added to your account. The amount is set by the Platform and may change.
  • Gems are not a currency: they cannot be exchanged for cash, transferred to another account, or used outside the Platform.
  • If a generation fails for technical reasons, the Gems reserved for that generation are automatically refunded to your balance.
  • Sales of Gem packages have not started yet; this section will be updated with pricing, invoicing and refund flows once the payment infrastructure is in place.

5. Right of Withdrawal and Refunds

Under Turkish distance selling regulations, Gem packages qualify as a "service performed instantly in electronic form". We nevertheless grant a right of withdrawal on the following condition:

If you have used NONE of the Gems in a purchased package, you may request a refund within 14 days of purchase through our contact page. Once a single Gem from that package has been spent, the right of withdrawal for that package ends.

Refunds are made using the original payment method within 14 days of the request being approved.

Note: paid purchases are not possible today because the payment infrastructure is not live yet; this clause takes effect when sales open.

6. AI Outputs

Content you create on the Platform is generated by artificial intelligence models. This has several consequences:

  • Outputs may be wrong, incomplete or misleading. They must not be relied on alone for medical, legal, financial or similarly critical decisions; Eflatun does not warrant their accuracy.
  • The same or a similar prompt may produce similar outputs for other users. No exclusive right can be claimed over an output.
  • To the extent applicable law allows, you may use the content you generate commercially. Responsibility rests with the user.
  • It is the user's responsibility to ensure that an output does not infringe third-party copyright, trademark or personality rights.

7. Prohibited Uses

You may not use the Platform to:

  • Produce unlawful content, hate speech, glorification of violence or discriminatory material.
  • Produce imagery or audio that impersonates real people without their consent, damages their reputation, or is sexual in nature.
  • Produce any material relating to child abuse (accounts are closed without warning and reported to the authorities).
  • Produce forged documents, fake identities, fraud or phishing material.
  • Place excessive automated load on the infrastructure, attempt to circumvent rate limits, or bypass security controls.

Breach of these rules may result in suspension or closure of your account; unused Gems are not refunded in that case.

8. Intellectual Property

The Platform's design, interface, brand, logo and source code belong to Eflatun; they may not be copied, reverse-engineered or used in derivative works.

Files you upload and content you generate belong to you. We process them only to provide and improve the service and — where you have explicitly allowed it — to feature them in the Explore showcase.

9. Featuring in Explore

Works in your library are private by default. Featuring a work in the Explore showcase requires your separate, explicit permission, and you may withdraw a featured work at any time.

10. Limitation of Liability

Eflatun does not undertake that the service will be uninterrupted or error-free. To the maximum extent permitted by applicable law, we accept no liability for indirect damages, loss of profit or loss of data.

For direct damages, total liability may not exceed the amount you paid to the Platform in the twelve months preceding the event.

11. Changes, Governing Law and Disputes

These terms may change. Material changes are announced on the Platform before taking effect, and the "Last updated" date on this page is renewed.

Turkish law applies to this agreement. Consumer arbitration committees and consumer courts have jurisdiction over disputes; the monetary thresholds are published annually by the Turkish Ministry of Trade.
